Overview: Fraudulent misrepresentation and nondisclosure claims were properly dismissed for failure to state a claim as the Mo. Sup. Ct. R. 55.05 pleading requirements were unmet. The petition failed to allege that the statement that her husband would go to jail if she did not sign was false, or that the speaker knew so, and, further, it was not actionable.

Overview: Circuit court properly applied the doctrine of prior jurisdiction in determining that the City of St. Joseph took the first valid step towards annexation of the subject territory, because the Village of Agency had no authority to pursue voluntary annexation of the same territory while the City was proceeding under Mo. Rev. Stat. § 71.015.
