Overview: In suit against insurer, insured was entitled to damages and attorney fees, pursuant to Mo. Rev Stat. § 375.420, because evidence was introduced that insurer failed to pay claim and it persisted in refusing to pay claim. Moreover, jury instructions tracked statutory language and did not confuse jury, so trial court properly denied JNOV.
