Overview: Where an employee, a professional athlete, was awarded workers' compensation benefits, the employer was properly given a credit for wages paid after the injury pursuant to Mo. Rev. Stat. § 287.270 because, inter alia, an exception was created for professional athletes under a contract and the statute did not violate equal protection or due process.

Overview: Where a bank did not disclose that the EPA was investigating property before selling it, the buyer's action pursuant to the Merchandising Practices Act, Mo. Rev. Stat. § 407.020, was improperly dismissed, though he was not entitled to punitive damages, as, that it was not amended until 2000 to permit a private cause of action, did not bar his suit.

Overview: In a medical malpractice action, trial court erred in, inter alia, requiring the medical group to pay post-judgment interest under Mo. Rev. Stat. § 408.040 from June 18, 2003, the original but subsequently vacated judgment, because the claims of all parties were not finally adjudicated until the circuit court entered judgment on February 21, 2006.
