Overview: In a medical malpractice suit, plaintiffs waited until the day of the summary judgment hearing to file an expert's letter stating that the surgical procedure did not meet the standard of care. The letter was insufficient to create a material issue of fact. Summary judgment in favor of defendants was appropriate under Mont. R. Civ. P. 56(c).
