Overview: The bank did not owe a fiduciary duty to a landowner, which was a question of law that was properly resolved on summary judgment; under Mont. Code Ann. § 28-2-1711, the landowner's claim to rescind an easement she granted to homeowners for their bank loan failed because there was no undue influence, fraud, or mistake as claimed.
