Overview: Trial court's ruling denying defendant's request to play an entire tape for the jury did not prejudice him for purposes of Mont. Code Ann. § 46-20-701(1) and reversal was not required; there was sufficient evidence supporting defendant's conviction of driving under the influence of alcohol in violation of Mont. Code Ann. § 61-8-401.

Young v. State, No. 05-316, SUPREME COURT OF MONTANA, March 7, 2006, Decided
View this case - free

Overview: The trial court properly denied an inmate postconviction relief; certain claims were procedurally barred under Mont. Code Ann. § 46-21-105(2), other claims were time-barred under Mont. Code Ann. § 46-21-102(1)(a), and the inmate's claim of ineffective assistance of counsel was without merit.
