Overview: During voir dire in a DUI trial, a prospective juror revealed the issue of DUI was a "sore subject" for him because he had been injured by a drunk driver. The juror showed a lack of impartiality within the meaning of Mont. Code Ann. § 46-16-115(2)(j). The district court abused its discretion in denying defendant's challenge for cause.
