Overview: Tenant alleged a landlord purported to evict her so she could occupy the unit herself but then leased it to another tenant, in violation of New Jersey Anti-Eviction Act, N.J.S.A. §§ 2A:18-61.1 to -61.12. As the landlord had the burden of proving her failure to personally occupy unit was not arbitrary, trial court erred in dismissing tenant's claim.
