Overview: Because a nephew was a fiduciary who benefitted from his transactions with his aunts, a presumption of fraud arose, but the nephew's affidavit rebutted that presumption. The nephew averred, inter alia, that he never took action on behalf of his aunts without their knowledge and consent, and never converted any assets to his own benefit.
