Overview: When investment companies said employees were unavailable for deposition before a certain date, due to another case, a discovery deadline made the demand unreasonable, and, as parties could not agree, an order allowing depositions on 10 days' notice governed, so no N.C. Gen. Stat. § 1A-1, N.C. R. Civ. P. 26(c) (2007) protective order was necessary.

Overview: Former employee's 10th affirmative defense failed and the former employer was entitled to judgment on the pleadings pursuant to N.C. R. Civ. P. 12(c); restrictive covenants in stock purchase agreement (SPA) were not substituted for those in amended employment agreement (AEA) and SPA merger clause did not eliminate his obligations under the AEA.
