Overview: Where the owners, third-party claimants, sued the adjuster for the insurers alleging negligent misrepresentation, the trial court properly, pursuant to N.C. Gen. Stat. § 1A-1, N.C. R. Civ. P. 12(b)(6), dismissed the action. The relationship between the adjuster and the owners was too attenuated to impose a duty on the adjuster owed to the owners.
