Overview: Absent trespass, there was no felonious larceny under N.C. Gen. Stat. § 14-72. Trial court should have dismissed a larceny charge based on defendant's admission that she dug up and spent money earlier buried by the victim in land defendant was renting. No trespassory taking occurred since lease granted defendant lawful possession of the land.
