Overview: N.C. Gen. Stat. § 90-95(h)(5) allowed trial court to depart from a statutorily mandated sentence if defendant, who pleaded guilty to trafficking in cocaine, rendered substantial assistance to law enforcement. In deciding not to reduce defendant's sentence, trial court did not err in finding that defendant failed to render substantial assistance.

Overview: When a trial court, sua sponte, vacated defendant's habitual felon conviction and reduced a sentence, the State could not appeal, under N.C. Gen. Stat. § 15A-1422 (2005), as the underlying judgment did not dismiss a charge or impose unauthorized prison. A writ of certiorari's requirements were not met, nor was it proper to suspend appellate rules.
