Overview: Defendant's aggravated sentence for second degree murder was proper because the trial court submitted the aggravating factors to the jury by way of a special verdict. Additionally, defendant was not subjected to an ex post facto law, in violation of U.S. Const. art. 1, § 10 and N.C. Const. art. 1, § 16, on the second degree murder count.
