Overview: Pursuant to N.C. Gen. Stat. § 1-75.12, the trial court stayed an action between banks to permit trial in New York. Although plaintiff's choice of forum was entitled to substantial weight, it had consented to jurisdiction in New York, and the New York federal court had a more expansive jurisdictional reach over witnesses than did North Carolina.
