Overview: Double jeopardy barred further prosecution of defendant on a gross sexual imposition charge because jeopardy had attached when jury was empaneled and sworn and then was discharged from case. Discharging jury was not manifestly necessary even though it was done for benefit of defendant, who had requested that a lawyer be appointed to represent him.

Overview: In a divorce action, a court's property distribution to the wife of $12,000 out of a net marital estate of $332,500 had to be reconsidered under N.D. Cent. Code § 14-05-24(1) because it was error to limit the distribution based on the husband's limited income and to fail to consider liquidation of the husband's farm property.
